On September 17, 2007, Craig Nelson, Freeborn County Attorney, along with representatives of teh Albert Lea Police Department and Freeborn County Sheriff's Office attended a meeting hosted by Lois Ahern and Michelle Severtson of the Freeborn County Public Health Service which discussed mailing Notices to businesses in Freeborn County and practical means of enforcing compliance with the "Freedom to Breathe" law which amends the "Minnesota Clean Indoor Air Act" (Minnesota Statutes 144.411 to 144.417).  The new law takes effect October 1st.
 
The "Freedom to Breathe" law prohibits smoking in bars, restaurants, and almost all indoor "places of employment".  While much public attention has been given to the effect of the new law on bars and restaurants, the law has far greater impact and effect!
 
Non-compliance with the law can result in an individual violator being fined up to $300.00 for each violation; and a fine of up to $300 for each violation where a business owner or manager allows a violation to occur.

Brandon Keith Benson appeared in Judge James Broberg's courtroom to address probation violations, which he admitted.  Benson requested execution of his sentence and Judge Broberg ordered Benson to serve 15 month prison with credit for the time he has already served.
 
Benson originally pled guilty to Felony Theft in January, 2006 for a crime committed at a residence in the city of Albert Lea.

Jeffrey Mauer, originally convicted in 2003 of Aiding and Abetting Manufacture of Methamphetamine, admitted August 27, 2007, to violating his probation by methamphetamine use.  Judge John Chesterman sentenced Mr. Mauer to 67 months in prison. 
 
Following his original sentence in 2003, Mr. Mauer entered and completed an 18-month treatment program at Minnesota Teen Challenge. 
 
Mr. Mauer's probation was in effect for 15 years.

Jason Dean Johnson received a sentence of 21 months in prison stayed, and was placed on probation for 0-25 years.  The terms of probation include: entering and successfully completing sex offender treatment; no unsupervised contact with persons under the age of 18 years; no use of mood-altering chemicals; complying with Predatory Offender Registration; and obeying all terms of probation.
 
Johnson has other pending charges in Steele and Waseca Counties.
